I. Collection of Information

Sonu Sleep collects information about you when you voluntarily provide it to us by visiting or using our Site, completing a transaction on our Site, or otherwise communicating with us, and we also collect information from our Service Providers (as defined in Section IV below). Additionally, when you use any Third Party Services (as defined in Section 1.2 below), those Third Party Services may also collect information about you or from you, which may be provided to us.

1.1 Types of Information We Collect

We collect a few different types of information about you or from you, including the following:

  • “Personal Information” is information that personally identifies you, such as your name, e-mail address, mailing information, telephone number, and your account information.
  • “Non-Personal Information” is information that does not personally identify you, including information that was Personal Information when collected, but was later de-identified to remove any information that could be used to personally identify you. When you visit our Site, we automatically receive aggregate Non-Personal Information about your device’s internet protocol (IP) address and the type of devise and web browser you use.
  • “Demographic Information” is a sub-category of Non-Personal Information about demographics, such as your age, gender, city, state and zip code, except to the extent any such Demographic Information is deemed to be Personal Information under applicable law.
  • “Transaction Information” is a sub-category of Personal Information that you provide to us when you place an order on the Site, such as your name, billing address, credit card payment information (including credit card number, expiration date and CVV number), any information you provide if you apply for financing, and any information provided when you access or use of the Site.


1.2 How We Collect Your Information

When you visit or use the Site, place an order to purchase any Sonu Sleep products, or otherwise provide information to us or Service Providers or any Third Party Services (as defined below), we may collect information from you or about you using any of the following methods:

  • Information You Provide. When you purchase any Sonu Sleep products on our Site, we collect the Personal Information you provide to complete the transaction. We may also collect other Personal Information from you, including your Demographic Information and Transaction Information, when you place an order on the Site, when you access or use the Site, or when you voluntarily provide any information to us. For example, we may collect your Transaction Information when you create, upload, post, publish, transmit or otherwise provide reviews, messages, comments, responses, photos, content, information, questions, or similar materials on the Site (collectively, “User Content”) regarding our products and services, including our Site, and other information derived from your User Content.

Sonu Sleep may automatically collect information about you when you access or use the Site, using cookies and other technologies, such as device recognition technologies and location-identifying technologies.   • Information Collected by Third Party Services. Our Site may also be integrated into or linked to third party software, applications, websites, advertisements, content, or other products or services, (collectively, “Third Party Services”). From time to time, Sonu Sleep may also receive Personal Information and Non-Personal Information about you from Third Party Services, and we may combine that information with information we collect. II. How We Use Your Information

When you visit or use our Site, engage in a transaction, or otherwise provide information to us, or if we receive your information from any Third Party Services, we use your information in accordance with this Privacy Policy, including any of the following purposes:

  • We may use your Personal Information, including your Transaction Information, to complete your order, collect your payment, deliver purchased products to you, and communicate with you regarding your transaction, including responding to any questions or warranty claims, and other legitimate business purposes.
  • We may use your Non-Personal Information, including your Demographic Information, to improve the operation of our Site, improve and customize our internal marketing and promotional efforts, statistically analyze Site use, improve our product offerings, and customize our Site’s content, layout, and services, and other legitimate business purposes.
  • When you provide your Personal Information to us, such as your email address and other contact information, and you opt in to receiving communications, we may use this information to deliver newsletters, promotional offers and other useful information to you.

III. Consent to the Collection and Use of Your Information

BY USING THE SITE, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED HEREIN. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THE SITE. When you provide your personal contact information, such as your email address, you are given your affirmative consent to receive promotional communications from us. If you change your mind after you provide your affirmative consent, you may withdraw your consent on the Site or by contacting us at legal@SonuSleep.com with an unsubscribe notice. If we send you any commercial communication via email, we will also provide an unsubscribe mechanism therein. Please allow up to 10 days for us to process any unsubscribe request.


IV. Sharing Your Information with Third Parties

4.1 Service Providers

We have made contractual arrangements with affiliates, service providers, partners and other third parties (“Service Providers”) to process your Personal information and Non-Personal Information on our behalf. Our Service Providers may need to use some of your information in order to perform tasks between our respective sites and to deliver products or services to you or to us.

For example, we must release your credit card information to the card-issuing bank to confirm payment for products purchased on the Site, release your address information to the delivery service to deliver products that you ordered, and provide order information to third parties that help us provide customer service. Other Service Providers include third parties who operate and maintain our Site and provide marketing services. In general, the Service Providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to you or us. Sonu Sleep does not authorize our Service Providers to use any information that we collect and provide to the Service Providers to send you direct marketing messages without your consent.

Sonu Sleep is not responsible for the privacy practices of our Service Providers. Many of our Service Providers, such as payment gateways and other payment transaction processors, have their own privacy policies governing the information we are required to provide to them for your purchase-related transactions. With respect to all Service Providers, we recommend that you read their privacy policies, so you can understand the manner in which your Personal Information will be handled by these providers. In particular, remember that certain Service Providers may be located in or have facilities that are located in a different jurisdiction other than either you or us. So, if you elect to proceed with a transaction, then your information may become subject to the laws of the jurisdiction(s) in which that Service Provider or its facilities are located.

We encourage our Service Providers to adopt and promote strong privacy policies. However, the use of your information by our Service Providers is governed by the respective privacy policies of those providers and is not subject to our control. Except as otherwise discussed herein, this Privacy Policy only addresses our collection, use and disclosure of information about you. We are not responsible for the policies or practices of third parties.

Shopify Inc.: Shopify is a Service Provider that provides us with the online e-commerce platform that allows us to sell our products to you on our Site. Some of your Personal Information is stored through Shopify’s data storage, databases and the general Shopify application. Your credit card information is never stored on our servers. We understand that Shopify stores your Personal Information on a secure server behind a firewall. Your Personal Information is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your Transaction Information is stored only as long as is necessary to complete your purchase transaction. After that is complete, your Transaction Information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our Site and its Service Providers. 4.2 Law Enforcement, Legal Process and Enforcement of Rights

From time to time, Sonu Sleep may be required by applicable laws or court orders to share Personal Information with law enforcement or in a court proceeding. We may be required to disclose Personal Information as necessary to comply with legal process, respond to court orders or subpoenas, or to comply with valid government investigations. We may also share Personal Information if we believe that such disclosure is reasonably necessary to enforce our Terms or our Additional Policies, or to protect and enforce any of our other legal rights or the legal rights of third parties.


V. Third Party Sites, Services and Content

Our Site may integrate with or link to Third Party Services. Please be aware that these Third Party Services may collect information about you and operate according to their own privacy practices which may differ from those contained in our Privacy Policy. These Third Party Services may use their own cookies, web beacons, and other tracking technologies to independently collect information about you and may solicit Personal Information from you. Third Party Services are outside of our control, and we do not take responsibility for their privacy practices, and we make no representation or warranty regarding the practices or policies of any third party associated with the Site, including Third Party Services and Service Providers.

We do not endorse, screen, or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting Third Party Services, Service Providers and any other websites, software or applications is at your own risk.

Our Site may also contain links and interactive features with various social media platforms. If you already use these platforms, their cookies may be set on your device when using our Site. If we do not combine this information, then the information collected, stored, and shared by Service Providers and Third Party Services remains subject to their privacy policies and practices.


VI. Sale of Your Information

When you visit and interact with our Site, certain third parties, such as Google, may receive access to your Personal Information for the purpose of providing you online advertising personalized to your interests, based on the websites you visit before and after you visit our Site. We do not otherwise sell, share, rent or trade the information your Personal Information. VII. Cookies and Other Technologies

We have adopted procedures to help us address any suspected personal data breach, and we will notify users of our Site and any applicable regulator of a data breach if we are legally required to do so.

XI. Retention of Your Personal Information

We will retain your Personal Information for as long as needed to provide you products or services, comply with our legal obligations, perform legitimate business functions, resolve disputes, and enforce our rights. Once Sonu Sleep determines that we no longer need your Personal Information, we will securely delete it or will de-identify it and aggregate it with other information.


XII. Children

Sonu Sleep does not intend to collect personal information as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) in a manner that is not permitted by COPPA. The Site is not intended or directed to children less than 13 years of age. You must be at least 18 years old to use this Site and/or purchase our products. We do not knowingly direct our products or services to children or collect, use, or disclose information about minor visitors. If you use our Site for any reason, you represent that you are at least the age of majority under the laws of the jurisdiction of your place of residence or that you are the age of majority under the laws of the jurisdiction of you place of residence.

If you believe your child has provided us with Personal Information, please alert us at legal@SonuSleep.com. If we learn that we have collected Personal Information from a minor, we will promptly take steps to delete such information and terminate the minor’s account as required by COPPA.


XIII. Rights of California Residents and Nevada Residents

12.1 Rights of California Residents

If you are a California resident, you have the right to request access to information, request the deletion of information, request Sonu Sleep Corporation disclose information, and request information about how Sonu Sleep Corporation sells or discloses your information to third parties for a business purpose. Regarding information we sell or disclose to third parties, you have the right to opt out of such sale or disclosure at any time. 12.2 Rights of Nevada Residents

Sonu Sleep does not currently sell any personal information under Nevada law. If you are a consumer in the State of Nevada, you may submit a request to opt-out of the future sale of certain of your personal information, as defined by Nevada law, by contacting us at legal@SonuSleep.com.


XIV. No International Transfers of Information

Sonu Sleep only offers our products or services in the United States, not including US territories, and we do not intend to offer our products or services to consumers in any other jurisdiction. DO NOT USE THIS SITE OR OTHERWISE SEND US INFORMATION UNLESS YOU CONSENT TO THE APPLICATION OF UNITED STATES LAW AND TO THE USE AND DISCLOSURE OF YOUR INFORMATION CONSISTENT WITH THIS PRIVACY POLICY.

If you use our Site from outside the United States, you will be transferring data to us in the United States, and your use will constitute your unambiguous consent and agreement that the transfer is freely given in compliance with the laws of the country where you are accessing and using our Site. XV. Mobile Phone & SMS Privacy

When opting in, by submitting a mobile phone number via forms on the SonuSleep.com website, Sonu Sleep Corporation will send SMS text messages to that number with offers, updates and information. The recipient can opt out of these messages at any time by replying with 'STOP'. The phone number submitted will not be sold to any third parties.


XVI. Changes to Our Privacy Policy

We reserve the right to change this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on the Site. If we make any material changes to how we treat our customers’ Personal Information, we will notify you by email to the primary email address specified in your account, and through a notice on our Site’s home page.
